LA CYGNE – An ordinance updating use of non-highway vehicles on the streets of La Cygne went into effect on Wednesday, Jan. 1, as residents rang in the new year. On Thursday, La Cygne Police Chief Zachary Mathies announced that the stickers required for owners of golf carts, worksite utility vehicles, and all-terrain vehicles on city streets were ready.
However, he also indicated that no one had yet applied for the now-required permit.
The La Cygne City Council on Wednesday, Dec. 18, voted unanimously to adopt an ordinance that would replace a section of the city code covering the operation of ATVs, side-by-sides and golf carts within city limits.
The updated code on non-licensed and non-agricultural vehicles would require owners to get a permit sticker and provide proof of liability insurance annually. In addition, the ordinance would prevent drivers without a valid drivers license – including children, elderly, and those with suspended or revoked licenses – from operating those vehicles on city streets.
Lawnmowers and vehicles used for transportation by handicapped individuals are exempt from enforcement under the new ordinance as is farm equipment.
Those vehicles are already prohibited from traveling on Kansas Highway 152 (Market Street) because it is a state highway. The vehicles can cross the highway but cannot drive on it.
The ordinance requires that owners of those vehicles pay $20 for an initial permit for each non-highway vehicle the first year and renew it annually for a $10 fee.
City officials said they would honor registration stickers on vehicles from other cities. While they indicated they believed that vehicle registrations from La Cygne would be accepted in other cities such as Linn Valley, they could not assure that was the case.
Violating the ordinance could carry a penalty of not less than $100 and not more than $500 per incidence.
In a lightly attended public hearing in November, two of the residents attending asked the council not to pass the ordinance, indicating that the current ordinance on the books was sufficient.
However, Councilman Thomas Capp pointed out that the new ordinance would require proof of liability insurance to operate those vehicles.
Below are excerpts of the final draft of the updated ordinance on non-highway vehicles that was approved by the La Cygne City Council on Dec. 18.
